Common social media apps such as TikTok are under fire by National Security and Government officials. The nature of these claims is rooted in a lack of trust in China, a war on big tech, a misunderstanding of data privacy, and a lack of comprehensive privacy legislation. Insufficient privacy laws concerning new-age technology serve as the main risk posed to users across all social media platforms. Implementing consumer data privacy laws can give users the right to control their data, but if poorly implemented these laws could also maintain the status quo.&nbsp;<\/p>\n\n\n\n<p>On the state level, there are currently only three states in the US each with different comprehensive consumer privacy laws: California (CCPA and its amendment, CPRA), Virginia (VCDPA), and Colorado (ColoPA). TikTok Policy Communications, Americas<\/figcaption><\/figure>\n<\/figure>\n<\/div>\n<\/div>\n<\/div><\/div>\n\n\n\n<p>\u201cInevitably it&#8217;s going to be regulated, but I think it&#8217;s going to be it&#8217;s going to be like kind of like marijuana laws or the way gay marriage was where it&#8217;s going to start with the states,\u201d said Jonathan Kotler, an attorney and associate professor at USC&#8217;s Annenberg School for Communication and Journalism. \u201cBecause the states will understand a whole lot better than the federal government..ultimately, you reach a point where it&#8217;s been regulated to so many places that the federal government is going to have to get involved, but they&#8217;re not going to, they&#8217;re going to go kicking and screaming until nothing.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-embed alignleft is-type-rich is-provider-soundcloud wp-block-embed-soundcloud\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"j414 by Yasmincbalci\" width=\"1140\" height=\"400\" scrolling=\"no\" frameborder=\"no\" src=\"https:\/\/w.soundcloud.com\/player\/?visual=true&#038;url=https%3A%2F%2Fapi.soundcloud.com%2Ftracks%2F1507489525&#038;show_artwork=true&#038;maxheight=1000&#038;maxwidth=1140\"><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>The data collected by the vast majority of apps or platforms individuals use every day isn\u2019t regulated. Since there are no federal privacy laws regulating many companies, this means they are pretty much free to do as they please with your data, unless a state has its own data privacy law. However, in most states, companies can use, share, or sell any data they collect about you without notifying you that they\u2019re doing so. Essentially requiring \u201conline platform operators to inform a user, prior to a user creating an account or otherwise using the platform, that the user&#8217;s personal data produced during online behavior will be collected and used by the operator and third parties. The operator must provide a user the option to specify privacy preferences, and an operator may deny certain services or complete access to a user if the user&#8217;s privacy elections create inoperability in the platform\u201d (<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/1667?q=%7B%22search%22%3A%5B%22Social+Media+Privacy+Protection+and+Consumer+Rights+Act%22%5D%7D&amp;s=1&amp;r=1\">S.1667 &#8211; Social Media Privacy Protection and Consumer Rights Act of 2021<\/a>).<\/p>\n\n\n\n<p>The act has two rules it would put in place, \u201cThe operator must (1) offer a user a copy of the personal data of the user that the operator has processed, free of charge, and in an electronic format; and (2) notify a user within 72 hours of becoming aware that the user&#8217;s data has been transmitted in violation of the security platform\u201d (<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/1667?q=%7B%22search%22%3A%5B%22Social+Media+Privacy+Protection+and+Consumer+Rights+Act%22%5D%7D&amp;s=1&amp;r=1\">S.1667 &#8211; Social Media Privacy Protection and Consumer Rights Act of 2021<\/a>). Although it\u2019s not been passed yet, this could offer protection of user data and educate users on their right to privacy.&nbsp;<\/p>\n\n\n\n<p>This act could be further bolstered by the bill introduced this past March, known as the RESTRICT Act. The Restricting the Emergence of Security Threats that Risk Information and Communications Technology Act is a piece of legislation said to comprehensively address the ongoing national security threat posed by technology by allowing the Department of Commerce to review any information or technology transaction they deem a risk to national security. This is more commonly known as the \u201cTikTok Ban\u201d bill.&nbsp;<\/p>\n\n\n\n<p>\u201cTwo issues are related: first is the general failure of privacy policy in the United States, so that&#8217;s all these companies, not just Chinese companies; the second is the national security risk posed by Chinese applications,\u201d said James Lewis Senior Vice President; Pritzker Chair; and Director, Strategic Technologies Program at the Center for Strategic and International Studies. \u201cSo it&#8217;s important to note it&#8217;s clearly one affects the other, the failure of privacy means there are other avenues for the Chinese when they engage in collection.\u201d<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/05\/Green-Simple-Budget-Pie-Chart-Graph.jpg\" alt=\"\" class=\"wp-image-21\" width=\"411\" height=\"308\" srcset=\"https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/05\/Green-Simple-Budget-Pie-Chart-Graph.jpg 1024w, https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/05\/Green-Simple-Budget-Pie-Chart-Graph-300x225.jpg 300w, https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/05\/Green-Simple-Budget-Pie-Chart-Graph-768x576.jpg 768w\" sizes=\"auto, (max-width: 411px) 100vw, 411px\" \/><\/figure><\/div>\n\n\n<p>TikTok currently holds 1 billion out of 3.96 billion social media users, for<a href=\"https:\/\/wallaroomedia.com\/blog\/social-media\/tiktok-statistics\/#:~:text=Monthly%20Active%20Users%20%E2%80%93%20TikTok%20officially,%E2%80%93%20480M%2C%20Twitter%20%E2%80%93%20300M.\"> reference \u2013 active users of other social platforms: Facebook \u2013 2.9B, YouTube \u2013 2.2B, Instagram \u2013 1.4B, TikTok \u2013 1.0B, Snapchat \u2013 750M, Pinterest \u2013 480M, Twitter \u2013 300M.<\/a> However, it\u2019s not the first app to be under fire, Snapchat, TikTok, and Youtube were all previously in hot water in 2021 for child safety issues. Every so often a new app comes under scrutiny, this time it\u2019s TikTok, due to the nature of its Chinese origins and the potential that American data can be sold to the Chinese government.<\/p>\n\n\n\n<p>\u201cThere are two simultaneous wars,\u201d said Kotler. \u201cAnything Chinese is by definition, bad, unsuspecting, and hurts national security and our ability to compete. That&#8217;s one and there&#8217;s the other one we talked about this morning, people are finally worried that big tech has gotten too big. I don&#8217;t think they would be going after TikTok if there wasn&#8217;t the war against big tech and if it wasn&#8217;t owned by the Chinese.\u201d<\/p>\n\n\n\n<p>For background, back in 2022, <a href=\"https:\/\/www.statista.com\/statistics\/272014\/global-social-networks-ranked-by-number-of-users\/\">Social networking was estimated to reach 3.96 billion users and these figures are still expected to grow as mobile device usage and mobile social networks increasingly gain traction in previously underserved markets.<\/a> However, big tech has seen pushback since 2020. Authorities such as \u201cthe Federal Trade Commission (FTC), the Department of Justice (DOJ), and the European Union (EU) have filed lawsuits against major U.S. tech companies, alleging they have relied on anti-competitive methods to maintain monopolies over social media platforms, search engines, advertising, and app stores\u201d (<a href=\"https:\/\/nationalinterest.org\/blog\/techland-when-great-power-competition-meets-digital-world\/2023-will-be-huge-year-war-big-tech\">2023 Will Be a Huge Year for the War on Big Tech<\/a>).<\/p>\n\n\n\n<p>This lines up well with the stigma against China and its \u201cChinese App\u201d TikTok. Back in 2020 was also the worldwide pandemic, where the COVID-19 outbreak responsibility fell to China as well as TikTok blame. This is most notably due to President Trump ordering the banishment of the app within 45 days of his <a href=\"https:\/\/www.washingtonpost.com\/technology\/interactive\/2022\/bytedance-tiktok-privacy-china\/\">decree<\/a>. Eventually, a deal fell into place where about 53% of TikTok Global\u2019s shares were held by either American investors or two American companies, <a href=\"https:\/\/www.cnbc.com\/2020\/09\/21\/tiktok-deal-splits-control-between-us-and-chinese-owners.html\">Oracle and Walmart<\/a>.<\/p>\n\n\n\n<p>The original deal is now moot and the war on big tech has since escalated. In March of this year, the Biden administration pushed for the app to either be sold to the US or be <a href=\"https:\/\/www.nytimes.com\/2023\/03\/15\/technology\/tiktok-biden-pushes-sale.html\">banned<\/a>. Leaving users angry and in limbo. But users fail to understand how their data is being sold and why acts such as the Social Media Privacy Protection and Consumer Rights Act and RESTRICT Act would protect their right to privacy and their data.<\/p>\n\n\n\n<p>\u201cNational and privacy security will always be at risk as long as social media is relevant due to foreign intelligence entities and criminals attempting to actively deceive individuals and organizations through social media platforms in order to gain access to certain information,\u201d said Kelley Green a student at the Unversity of Southern California.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-center\"><em><strong>Common Apps we think are the only ones to steal our data<\/strong><\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"342\" src=\"https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/04\/Screen-Shot-2023-04-12-at-5.43.00-PM-1024x342.png\" alt=\"\" class=\"wp-image-10\" srcset=\"https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/04\/Screen-Shot-2023-04-12-at-5.43.00-PM-1024x342.png 1024w, https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/04\/Screen-Shot-2023-04-12-at-5.43.00-PM-300x100.png 300w, https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/04\/Screen-Shot-2023-04-12-at-5.43.00-PM-768x256.png 768w, https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/04\/Screen-Shot-2023-04-12-at-5.43.00-PM-1536x513.png 1536w, https:\/\/ascjcapstone.com\/spring-2023\/ybalci\/wp-content\/uploads\/2023\/04\/Screen-Shot-2023-04-12-at-5.43.00-PM-2048x684.png 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>As stated formerly, this is not the first app to come under fire for data privacy, many popular mental health apps such as BetterHelp and Talkspace act the same as social media apps when it comes to using your data. As your data gets passed around between countless third parties, there aren\u2019t just more companies profiting from your data, but also more possibilities for your data to be breached in a way that causes true harm. Such that, if a company shares your data, including sensitive information such as your health or location, with third parties (such as Chinese data collection companies) those third parties can further sell it or share it without ever notifying you.&nbsp;<\/p>\n\n\n\n<p>\u201cI think the truth of what&#8217;s happening is so much worse, because the tracking that\u2019s happening to us is so effective, that companies are able to learn things about you that you don&#8217;t realize that you&#8217;re exposing, and it works so well, that it feels like they must be listening to you, but they&#8217;re not, which I think is 100 times worse,\u201d said Thomas Germain, a journalist at Gizmodo. \u201cPeople believe that there&#8217;s some law in the United States about privacy, and there&#8217;s really not\u2026so I think that the prevalence of this kind of tracking, and what companies are able to do is still really a mystery to people even now, at a moment where people think they understand it more than they ever have before.\u201d<\/p>\n\n\n\n<p>The main point is it\u2019s not just social media apps, it&#8217;s every app you use, from TikTok to BetterHelp. The U.S. does not have one singular law that covers the privacy of every type of data, <a href=\"https:\/\/www.nytimes.com\/wirecutter\/blog\/state-of-privacy-laws-in-us\/\">instead, it has a mix of laws that go by acronyms such as HIPAA, FCRA, FERPA, GLBA, ECPA, COPPA, and VPPA.<\/a><\/p>\n\n\n\n<p>The only useful data privacy act out of all of the current pieces of legislation is the Federal Trade Commission Act (FTC Act) which grants the FTC the ability to go after an app or website that violates its own privacy policy. It also allows the FTC to investigate violations of language related to privacy, as in the case of the app Zoom, which deceived users by saying video chats were end-to-end encrypted.&nbsp;<\/p>\n\n\n\n<p>Congress blames social media, but really it&#8217;s big tech taking advantage of user data and a lack of privacy legislation not protecting citizens. Incorporating privacy laws such as the Social Media Privacy Protection and Consumer Rights Act and the RESTRICT Act would protect users across all social media platforms.
